CONDITIONS AND TERMS OF CONTRACT
DEPOSITS/PAYMENT/TRANSPORT
A $200 deposit will be required to hold your puppy. Puppies are reserved on a first deposit received basis. Deposits can be paid via PayPal, personal check or in cash. Your puppy will be on reserve as pending and if deposit is not received within 10 DAYS (unless other arrangements are made) of agreement to purchase then it will be placed for sale again. Should a suitable puppy not be available from the litter, deposits will be honored on future litter(s). Deposits are non-refundable unless there is a health issue while the puppy is in the care of the breeder.
The puppy must be paid in full by 8 weeks old. If payment has not been made by 8 weeks, Maggie or Brian will contact buyer. Buyer will be given 72 hours to pay in full, or the buyer may be given an opportunity to make suitable payment arrangements. Decisions about puppy/deposits paid and all other matters pertaining to said puppy will be at the sole discretion of Maggie or Brian Tidyman.
Puppy must be picked up or shipped by 9 weeks of age or buyer will be charged a $25/week boarding fee in addition to any routine or emergency expenses the puppy may require until the time of pickup/shipment. Charges must be settled in full before puppy will be released into the buyer’s care.
Shipping is available and can be arranged by Maggie or Brian Tidyman at the buyer’s request. Such costs are the responsibility of the buyer and are not included in the agreed price of the puppy.

PUPPY GUARANTEE
Puppy shall be in good physical condition at the time of shipment and up to 48 hours thereafter. It is the responsibility of the buyer to take puppy to a licensed Veterinarian for a complete physical examination within 3 business days of receiving puppy in order to receive the health guarantee.
Puppy is guaranteed to be free from any genetic/hereditary defects that can cause death or serious impairment of vital functions in the puppy, until puppy is 1 year old unless the buyer continues to provide their puppy with Tracer dog tabs then the buyer will receive a 2 year health guarantee. Samples and ordering information will be given at the time buyer picks up their puppy. Full bottles are also available at the time of pick up In the event your puppy develops an inheritable/genetic disease before his/her first birthday that is life threatening or causes serious impairment of vital functions, the buyer is entitled to a replacement puppy of similar value or quality, when one becomes available. Arrangements must first be made to place diseased/impaired puppy back with Maggie and Brian Tidyman.
For this guarantee to be valid, Brian and Maggie Tidyman requires medical records from a licensed Veterinarian in writing clearly documenting the diagnosis. We reserve the right to a second veterinary opinion. Additionally, under no circumstances shall Maggie and Brian Tidyman be liable for veterinary expenses.
Puppies are at risk for Kennel Cough, Coccidia and Giardia, which are often associated with the stress of shipping, a new home, new food, new people, change of climate or surroundings, etc. Puppies that are shipped are more prone to these minor ailments. Maggie and Brian Tidyman will not cover the costs of treatment or exchange a puppy for the reasons mentioned above.
Puppy will have his/her tail docked, will receive deworming treatments at 6 and 8 weeks old, and be inoculated with a first and second set of vaccinations. Full information about veterinary treatments will be provided. Your puppy will receive a vaccination against Parvovirus. It is the buyer’s responsibility to complete the vaccination series. If puppy contracts a vaccinable illness once it leaves our care, no replacement puppy will be provided.
This guarantee does not cover what may be considered “normal” for Australian shepherds or beyond our control.

THE BUYER AGREES TO THE FOLLOWING:
This puppy is to be registered with ASDR if rights to register are given.
If the buyer is buying the puppy as a pet, the buyer shall ensure puppy is spayed or neutered, not sooner than 6 months of age and not later than 18 months of age, unless deemed medically necessary by a licensed veterinarian. Breeder reserves the right to request proof of spay/neuter from buyer before registration papers are released in order to register the puppy. If the buyer does not wish to spay/neuter the puppy, then no registry papers will be issued.
If the breeder deems the puppy to not be breeding quality (overbite, mismarked, and/or any other breed specific concern) then the purchase of the puppy will be PET ONLY and will require that it is spayed or neutered.
If the buyer purchased breeding rights, buyer must not use puppy for breeding before 18 months of age. Buyer must only breed puppy with another purebred Australian shepherd, and must first notify Maggie or Brian Tidyman of the intent to breed.
The buyer agrees the puppy will never be abused, neglected, or used for any kind of illegal purposes. Buyer also agrees to provide proper shelter, food, water, and never leave the puppy on a chain for extended periods of time. Buyer also commits to provide necessary veterinary check -ups and vaccinations as recommended by a licensed veterinarian. If the puppy shows signs of neglect or abuse, ownership of the puppy will immediately return to Brian and Maggie Tidyman without any return of monies to the buyer.
In the event the buyer can no longer own a dog or provide proper care for the puppy, buyer must not euthanize, take puppy to an animal shelter, or breed rescue. Instead buyer must return puppy to Maggie and Brian Tidyman. This puppy must never be given away, or sold to any individual, company or research facility without the written permission of Maggie and Brian Tidyman.
The terms of this contract last the puppy’s entire life and failure to abide by the conditions set forth in this contract will result in Maggie and Brian Tidyman taking ownership of dog and/or civil litigation, without any refunds of monies paid for puppy.
Maggie and Brian Tidyman reserves the right to refuse or cancel the sale of a puppy to anyone at any time. In the event that Maggie and Brian Tidyman decides to cancel the sale of the puppy, the buyer will be refunded his/her monies in full.
